These Terms and Conditions (the "Terms") govern the use of the macOS application Lexcase (the "App") provided by ICLVS Legal Intelligence LLC ("we"). By downloading, installing or using the App, you accept these Terms.
1. Acceptance
By installing or using the App, you declare that you have read, understood and accepted these Terms. If you do not agree, do not install or use the App.
2. License
We grant you a limited, personal, non-exclusive, non-transferable and revocable license to install and use the App on macOS devices you control, solely for lawful purposes within your professional practice.
This license does not include the rights to:
- Copy, distribute or sublicense the App.
- Modify, decompile, reverse engineer or attempt to derive the source code, except as permitted by applicable law.
- Remove copyright notices, trademarks or other ownership indications.
- Use the App to build competing products or derivative services.
3. Intellectual property
The App, its texts, designs, source code, icons, trademarks, logos and associated materials are owned by ICLVS Legal Intelligence LLC or its licensors and are protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you.
4. User content
You retain all rights over the information you enter in the App (cases, contacts, notes, calendar, finances). Because all of it lives locally on your Mac, we do not receive or store any copy on our servers.
You are responsible for:
- The accuracy and legality of the information you record.
- Complying with your professional confidentiality duties towards your clients.
- Keeping adequate backups of your information (the App provides JSON export and import).
5. Usage restrictions
You agree not to use the App to:
- Engage in illegal, fraudulent or deceptive activities.
- Store content that infringes third-party rights.
- Compromise the security of the App or access unauthorized parts.
- Distribute the App to third parties without our written authorization.
6. App provided "AS IS"
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the App will be error-free, uninterrupted or meet all of your specific requirements.
7. Limitation of liability
To the maximum extent permitted by applicable law, ICLVS Legal Intelligence LLC will not be liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profits, revenue, data, opportunities or reputation, arising from the use of or inability to use the App.
Specifically, the App is an organization tool; it does not replace the attorney's professional judgment, deadline compliance or due diligence in handling matters. You are solely responsible for legal decisions and procedural deadlines applicable to your cases.
8. Indemnification
You agree to indemnify and hold harmless ICLVS Legal Intelligence LLC against any claim, demand or damage arising from misuse of the App or breach of these Terms.
9. Updates
We may release updates to the App from time to time. Some updates may be mandatory for security or compatibility with new macOS versions. We are not obligated to maintain indefinite compatibility with older macOS versions.
10. Termination
These Terms remain in effect while you keep the App installed. We may suspend or terminate your license if you breach these Terms. You may terminate the license at any time by uninstalling the App. Clauses that by their nature should survive (intellectual property, limitation of liability, governing law) will remain in effect after termination.
11. Changes to these Terms
We may update these Terms to reflect legal, technical or business changes. The date of the last update appears at the top of the document. If changes are material, we will notify you via an in-app notice or at this same URL.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Dominican Republic, without regard to its conflict of laws principles. Any dispute arising from the use of the App will be submitted to the competent courts of the National District, without prejudice to mandatory consumer rights where you reside.
